Effective date: January 1, 2026
These Terms and Conditions ("Terms") govern your use of the website located at lafayettemasonrycontractor.com and your engagement of services provided by Lafayette Masonry & Concrete ("Company," "we," "us," or "our"). By accessing this website or requesting services from us, you agree to be bound by these Terms. If you do not agree, do not use this website or engage our services.
By using this website or entering into any service agreement with Lafayette Masonry & Concrete, you confirm that you are at least 18 years old and have the legal authority to accept these Terms on behalf of yourself or any entity you represent. Use of this website constitutes acceptance of these Terms as they exist at the time of your visit.
Lafayette Masonry & Concrete is a masonry and concrete contractor serving residential and commercial customers in Lafayette, Indiana and the surrounding communities. Our services include foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, brick wall installation, stone masonry, and related work.
All services are performed at the customer's property by appointment. We do not accept walk-in inquiries at our office. The scope of each project is defined in a written estimate or service agreement provided to the customer before work begins.
All estimates are provided in writing following an on-site assessment. Estimates are valid for 30 days from the date issued unless otherwise stated. An estimate is not a guarantee of final cost - if conditions discovered during the work require additional labor or materials beyond the original scope, we will notify you in writing before proceeding with any changes that affect the price.
We do not provide binding quotes over the phone or by email without an on-site inspection. Verbal representations about price are not binding and do not constitute a contract. Only a written, signed estimate or service agreement constitutes an agreement to perform work at the stated price.
Appointments for estimates and project start dates are scheduled by mutual agreement. We reserve the right to reschedule due to weather conditions, crew availability, or other circumstances beyond our control. We will notify you as promptly as possible if a rescheduling is necessary.
If you need to cancel or reschedule a scheduled appointment, please notify us at least 48 hours in advance by phone or email. Cancellations with less than 24 hours notice may result in a rescheduling fee, which will be communicated to you at the time of booking if applicable.
Payment terms are specified in each written estimate or service agreement. In general, a deposit may be required before work begins, with the remaining balance due upon completion. The specific deposit amount and payment schedule will be stated in your written agreement.
Payment is accepted by cash, check, or other methods specified at the time of service. Invoices not paid within the terms stated in the service agreement may be subject to a late fee. If payment is not received, we reserve the right to pursue collection through all legally available means, including but not limited to filing a mechanic's lien on the property in accordance with Indiana law.
All prices are stated in U.S. dollars. Applicable taxes are the responsibility of the customer unless otherwise noted in the service agreement.
Where a written warranty is provided with a specific job, the terms of that warranty govern. Unless a written warranty is provided, our work is delivered "as is" based on the conditions present at the time of the project.
We make no warranty, express or implied, regarding the fitness of completed work for any particular purpose beyond its stated scope. We are not responsible for pre-existing conditions discovered after work begins that were not visible or disclosed at the time of the estimate, or for damage caused by conditions outside our control, including soil movement, flooding, freeze-thaw cycles, or the actions of third parties.
To the fullest extent permitted by applicable law, Lafayette Masonry & Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from the services we provide shall not exceed the total amount paid by you for the specific project giving rise to the claim. This limitation applies to all claims, whether based in contract, tort, negligence, strict liability, or any other legal theory.
The content on this website - including text, images, and other materials - is provided for informational purposes only. We make reasonable efforts to keep this information accurate and up to date, but we do not warrant that the content is complete, accurate, or free of errors.
You may not copy, reproduce, or distribute content from this website for commercial purposes without our prior written consent. You agree not to use this website for any unlawful purpose or in any way that could damage, disable, or impair the website or interfere with other users.
We prefer to resolve any disputes directly and informally. If you have a concern about our work or this website, please contact us first at the information below and give us a reasonable opportunity to address the issue before pursuing any formal action.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before initiating any legal proceedings. Mediation shall take place in Tippecanoe County, Indiana, using a mutually agreed-upon neutral mediator. The costs of mediation shall be shared equally unless otherwise agreed.
These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought in the state or federal courts located in Tippecanoe County, Indiana, and you consent to the exclusive jurisdiction of those courts.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of this website or our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
